The Labor Standards Act, also known as the Fair Labor Standards Act (FALLS), is a federal law that oversees child labor, minimum wages, and overtime. Its purpose is to safeguard workers from unjust labor practices like unequal pay, excessive work hours, and lack of overtime compensation. FALLS has specific regulations concerning child labor which include the prohibition of children under 14 from working and regulation of employment for those aged 14 to 18. In nonagricultural operations, it limits the working hours for children under 16 and prohibits certain hazardous jobs for those under 18. In agricultural operations, it forbids children under 16 from working during school hours in order to protect their educational opportunities and ensure their health and safety. Countries such as India, Africa, and Asia with prevalent poverty often force children as young as five
...years old to work due to economic circumstances.
Minimum wage refers to the lowest hourly wage that employers must pay their employees. The current federal minimum wage stands at $7.25 per hour for covered non-exempt employees since July 24th, 2009. However, some states have higher minimum wage requirements compared to the federal rate.Certain exceptions exist regarding the payment of minimum wage to specific employees. For example, there are exemptions for workers under 20 years old or those who receive tips as part of their income. It is important to note that FALLS does not provide procedures for collecting wages that exceed the legally mandated minimum set by employers themselves. Some states have laws that allow employees to file claims for additional wages and benefits. President Obama proposed increasing the minimum wage to $9 and tying it to inflation. Moreover,
there are several exceptions to these regulations, such as employment by parents, newspaper delivery, and child actors.
