The New York Times published classified documents from the Pentagon regarding the Vietnam War. Daniel Ellsberg, a writer at the Pentagon, leaked a confidential 47-volume history of American involvement in Vietnam to both the Times and later the Post. The Times gradually released these papers until they were ordered by the Nixon administration to stop publishing. The Supreme Court determined that issuing an injunction against the Times based on their First Amendment rights was not allowable. This raises concerns about whether federal documents are protected under the First Amendment and if imposing prior restraint is unconstitutional. It also prompts questions about whether injunctions can legally restrict press coverage, even when national security is involved.

June 25, 1971, the Supreme Court decided in a 6-3 vote in favor of the New York Times, ruling that an injunction against the press is not allowed under the First Amendment. The court determined that the Government did not present enough evidence or fulfill its burden of proof to justify prior restraint. When there are valid reasons for prior restraint, it is crucial for the government to bear a significant burden of proof. If this burden is not adequately met, an injunction cannot be issued. The First Amendment safeguards individual rights and press freedom without any limitations on communication. However, if the U.S. aims to prevent publication they consider harmful, they must meet their evidentiary requirements and satisfy their burden of proof as mandated by courts.
