Physical pain infliction on a person as punishment for a crime is known as corporal punishment. These punishments take many forms includingflogging, beating and blinding. Corporal punishment also means the physical disciplining of children at home and school.Ancient Babylonian law come-up with the principle of Corporal punishment, this law asserted that criminals should be inflicted with the same injuries they had brought upon their victims. From 18th century, this form of punishment was commonly used in instances that didn’t require death penalty or for exile. But humanitarian ideals changed and led to the gradual abandonment of the form punishmentStraus, (Murray 1109-1114).
This punishment does not exist in most nations legal systems nowadays. For example, the last flogging in the United States was carried out in Delaware in 1952. In Britain this law was seriouslylimited by th
...e Act of 1948 of criminal justice and was later completely abolished in 1967. This form of punishment still exists in Middle Eastern nations. This includes amputation and whipping,strict observation of theIslamic laws or the ‘Sharia’, allows for this. Also Corporal punishments and other forms are still existent in some nation’s prisons; this might be legally or covertly. Even though this happens it is explicitly prohibited by several human rights groups which include the European Convention on Human Rights(Straus 84-90).
This type of punishment has serious implication to the afflicted as well as the general public and this is evidenced by the fact that it is cruel and inhumane, and should not be allowed in the United States or any other country in the world. Laws provisioned for in many countries Constitutions prevent the cruel and unusual punishment against people and shoul
be enhanced for better results of the same. Additionally striking, flogging or amputating people are not constructive forms of punishment.
Corporal punishment is also unnecessary and counter- productive.There is a huge amount of evidence that suggests that corporal punishments makes way for low self-esteem, violence, and serious psychological issues if inflicted in children it will affect them even in adult hood this is also the same with the adults. It is also evident that spanking leads to lower IQ scores in children. This type of punishment is also counterproductive in that children undergoing this are likely to misbehave more than the ones who are not punished this way. In conclusion, this type of punishment should not be allowed in any quarters of life because it is not beneficial to anyone the inflicted or the society it is also barbaric and outdated (Durrant437-455).
