In this study, we are going to analyze public health, legal and policy issues which are involved in mandatory school immunization program as signed by California Governor Gerry Brown SB 277, on 30th June 2015. We will be able to see how this issue is related to public health law and police powers of the states and individual constitution rights as well. Public health ensures safety of an individual, and the state at large. It does this by protecting individuals from falling sick, vaccinating them against deadly diseases and viruses and also educating them on how to practice healthy lifestyle and behaviors. diseases and thereby threatening the life of other children in California especially the immune compromised individuals. The courts and legislatures also support personal preferences over the public health needs thus respecting patient’s rights. The government should not carelessly interfere with either personal or economic freedom unless there is justification based on preventing a significant risk to public health safety. Because of this, the Governor instructed the public health department to allow religious exemptions that will make people opt out the important immunization process.

The police powers of the state work hand in hand with the public health department by promoting the general welfare of the California communities. They also make sure that the public health department does not violate rights of the patients, promote public health morals and safety by law enforcement policies. The police powers also work hand in hand with the state in preserving public health. They do this by preventing any type of injuries, preventing diseases by vaccine administration, enhancing good hygiene practices such as proper waste disposal which will assist in maintaining a clean environment. Use of biological agents as weapons has brought together the public safety and also the health strategies through public health law reforms. The Supreme Court has exercised supreme police power so as to protect lives, good health and morals, comfort as well as minding the general welfare of the state community in California. However several factors may limit the police powers. They include; onset of civil rights jurisprudence, in case there is a rise in patient’s autonomy and cases of federal encroachment of the state authority. to the enumerated powers by; looking at population health status and health needs to be able to fill the gap, passing laws and regulations and providing assistance to the states thus supporting international initiatives which are aimed at improving the states global health.

Following the immunization process, the public health departments should be able to understand the limits concerning compulsory power. They include; demonstrations following the subject of infections. In this they should be able to educate the members of the state on the importance of immunization and probably the risks they would pose to their health if not vaccinated. Also police power should be exercised fully without causing either physical or psychological harm to the individuals. The public health departments should exercise powers on discrimination basis which may be due to color, race or other backgrounds. Public health should adhere to the law by issuing work license to professionals such as nurses and physicians in order to regulate the number of illegal businesses in the state. They should also be able to inspect various premises and businesses such as hotels and tattoo parlors, zone commercial and residential areas. Public health departments should not create threats to the state communities by transfer of patient’s autonomy ethos into the public health activities they involve themselves in as it is against the patients will. The constitution guards’ individual interests in autonomy, privacy and confidentiality issues, and issues related to individual liberty and property management.

The public health law as in the constitution design allocates power among the federal government and the states so as to curtail individual liberty protection. The federal public health powers include; spending, taxing, and regulating

interstate commerce. The taxing power helps minimize the number of private activities which can endanger health of the state, the spending power aids in the funding for the public well being. Regulation of interstate commerce has enabled the national government to invade traditional realms of the state authority and also enhancing environmental conservation, good hygiene practices, purity of drugs and food and finally safe drinking water which is free from contaminants and other disease causing agents.
In conclusion, parents should understand the importance of the vaccination process and make informed decisions before putting personal belief exemptions and also ignore the negative misconceptions they have heard about vaccines and join the state and public health organizations in preventing diseases and promoting good health. This will cause a decrease in mortality rate of our children, and youths in our states.
