...Luis Alberto Jimenez, an undocumented immigrant living in Florida. Mr. Jimenez suffered significant brain damage and physical injuries due to a car accident caused by a drunk driver. Subsequently, he was hospitalized at Martin Memorial Medical Center for four months until June when he was transferred to a nursing home.
Mr. Jimenez's health worsened in January 2001, requiring him to return to the hospital where he had previously received treatment for an accident. Unfortunately, his status as an undocumented immigrant rendered him ineligible for government financial assistance for the necessary long-term rehabilitative care. As no suitable facilities were available in the United States, the hospital opted to pursue a court order to deport him back to Guatemala. However, Mr. Jimenez's guardian objected and consequently, the hospital enlisted a private company to forcefully deport him via an air ambulance. This decision by Martin Memorial Hospital violated
the Emergency Medical Treatment and Labor Act (EMTALA).
