Capital punishment or the death penalty is a legal process whereby a person is put to death by the state as a punishment for a crime. The judicial decree that someone be punished in this manner is a death sentence, while the actual process of killing the person is an execution.

Currently, 58 nations actively practise it, and 97 countries have abolished it. The real question that arises is whether it should be abolished or not. People have various views and arguments regarding Capital Punishment. Some people think that it should be abolished while some think it should not be abolished. I find abolishing Capital Punishment more reasonable rather than practising it. "A man who realizes his mistake and repents for it is a chastened man".

Such people who realize and repent for their mistakes usually not only become la

w abiding citizens but also become social reformers. The society plays an important role in inciting the man towards crime and it owes him at least a chance to realize his part or full and improve. However, the capital punishment strikes at the very root of this possibility.Besides a true moral punishment is the self-realization of the crime by the criminal and the death sentence simply deprives a man the opportunity to receive one is really aggrieved party. A comparative analysis of the statistics of murders in countries having death penalty with which have no death penalty reveals that there is no difference between the two when compared. Another argument for why capital punishmen

shouldn’t be allowed is that it is a contradiction.Every single human has the right to life. Even if they have committed hideous crimes such as murder, at their core they still are human beings even though the actions they undertook were deviant from the norm. It may be argued that a line needs to be drawn when a human being takes the life of another human yet how different is this to the executioner himself who deals the finishing blow to a death-row inmate? Both parties killed another person because of their own beliefs yet only the executioner is pardoned because he kills in the name of the state; in the ame of justice.

Yet what is justice but the product of survival of the fittest. The executioner is ‘just’ because he acts the norm while the criminal isn’t because he does not act the norm. Sir Jean Rostand once said, “Kill one man, and you are a murderer. Kill millions of men, and you are a conqueror. Kill them all, and you are a god.

” Our current law is determined by a group of people in society and therein lies the contradiction. If indeed capital punishment is the norm, then it should naturally be applied to all countries.Yet that is not the case with several countries instead foregoing capital punishment for life imprisonment instead. Since capital punishment isn’t the norm, then what difference is there between an executioner and the criminal? Wouldn’t that make the executioner himself culpable to having committed murder which would also make him liable for capital punishment? Some may argue here that an eye for an eye is required

for the punishment yet the problem with an eye for an eye is that everyone ends up blind; or if taken into the context of capital punishment, everyone would end up dead.Killing people isn’t the norm in society and exceptions shouldn’t be made in the judicial system. Thus, I would like to conclude by saying that Capital punishment should be abolished as not only is it immoral but also illogical.

Capital Punishment or Death Penalty if made a law, would be quite barbaric in nature and would be strictly against the Right to Life of any person in the eyes of law. - Rohan Krishna Seth, 12LLB057
