The first class session discusses the constitutional right of a motorcycle driver to choose not to wear a helmet. As an individual who rides motorcycles, I believe that I have certain constitutional rights and privileges. These rights allow me to use my earned money to purchase a motorcycle for personal transportation and entertainment. It is important to note that individuals possess rights beyond those explicitly outlined in the constitution, as stated in the ninth amendment (Jentz and Miller 20).
Currently, there are twenty state laws and eighty-four local laws that require motorcyclists and/or cyclists below a certain age, as well as their passengers, to wear helmets while riding. The purpose of these laws is to prevent head injuries and fatalities resulting from bike accidents.
While riding a mot
...orcycle is both my right and privilege, it is also my right to be fully informed about potential dangers before making a purchase. Being aware of existing helmet laws is one aspect of being informed, which I consider fortunate because wearing a helmet ensures safety for myself and my passengers.
Supporters argue that helmet laws prioritize public safety and health over democratic rights and personal freedom – an argument with which I agree. By following imposed laws, such as wearing helmets, I can maintain my various rights and privileges as a motorcycle rider. Owning and operating a motorcycle is one of the many privileges that I enjoy.According to Miller and Jentz (2000), wearing a helmet is essential for my safety while riding, ensuring the protection of my well-being without compromising my rights.
