Cohns vs. Virgnia

In this Supreme Court case, Chief Justice John Marshall decided that a state could not interfere with a federal agency exercising its powers within a state., 1819 The federal government chartered a national bank in 1816. The state of maryland levied a heavy tax on nonstate-chartered banks and McCulloch refused to pay the tax. The Supreme Court ruled that under the supremacy clause and elastic clause, the national bank served purposes of the Congress (issuing a national currency, levying taxes, and borrowing money) and therefore was constitutional. Significance: The federal government could exercise greater authority over state power through clauses in the Constitution that were interpreted in such a way that the federal government was favored. A SC ruling that protected the national government from incursions by the states. A powerful precedent that would allow future national policy to develop free of the constraints of state prerogatives.
