He refuses to fight him because he is now married to Juliet which mean their families are bonded which essentially is saying Romeo is a capulet and doesn't want to hurt someone in his family

Tybalt because he interprets Romeo's presence as an insult at the party and when Romeo shows up that day he thinks he has come to make fun of the capulet party. It is tybalts fault because he could not control his temper and he assumed false reasons for Romeo's presence.
